Equinix Cape Town Data Center Approval Faces Legal Challenge

U.S. digital infrastructure giant Equinix faces a potential legal challenge in South Africa after local planning authorities approved a major hyperscale data center project despite growing scrutiny over its projected power and water consumption.
The City of Cape Town’s Municipal Planning Tribunal granted preliminary land-use approval for two proposed facilities spanning more than 120,000 square meters in the King Air Industria precinct. However, public interest groups represented by the Legal Resources Centre are weighing a formal appeal. Opponents contend that municipal officials treated the application as a routine rezoning matter rather than assessing the complex environmental footprint of a major high-density facility.
Project estimates suggest the facility could draw between 160 and 174 megawatts of power, placing significant strain on the local electrical grid, as reported by Daily Investor. Civic organizations and environmental advocates, including technology justice group Foxglove and the Housing Assembly, raised concerns regarding cooling water consumption, diesel generator emissions during power outages and potential noise pollution.
According to reporting by Business Day, critics argue the city approved the project without requiring upfront disclosures regarding long-term resource allocation or cumulative environmental impacts. Opponents noted that while digital infrastructure investment is necessary, large-scale developments require clear baseline environmental data before construction permits are finalized.
Local officials stated that the initial tribunal decision is subject to an appeal window and that additional municipal approvals, including a detailed site development plan, remain mandatory before construction can begin. Municipal representatives noted that engineering departments will review technical infrastructure requirements, including utility supply and environmental compliance, in subsequent planning phases.
Addressing concerns over water security, South Africa’s Department of Water and Sanitation stated to IOL that municipalities must balance industrial growth with community water rights. Department officials noted that high-density facilities typically utilize closed-loop cooling systems that recirculate water, minimizing continuous raw water draw from local municipal supplies.
The regulatory dispute highlights growing international friction between rapid artificial intelligence infrastructure deployment and regional resource limits; a challenge increasingly faced by North American developers and municipal planners alike.
