The Supreme Court withdrew the contempt notice against Additional Registrar (Judicial) Nazar Abbas and dispatched the file to Chief Justice of Pakistan (CJP) Yahya Afridi for the constitution of full court on the powers of committees that decide to fix cases before benches.
“We find that he [Additional Registrar (Judicial)] did not deliberately avoid the fixation of the cases before the bench as directed in the court order [….] The show-cause notice issued against him for contempt proceeding is discharged,” read the 20-page verdict issued by the two-member bench comprising Justice Mansoor Ali Shah and Justice Aqeel Ahmed Abbasi.
Justice Mansoor Ali Shah ruled the case and said that the court order was not intentionally violated by the Additional Registrar Judicial, so the contempt of court notice against the Additional Registrar Judicial is withdrawn.
The decision states that the Judges Committee and the Constitutional Committee violated the court order. The court sent the file to the Chief Justice to set up a full court on the powers of the committees.
The decision of the Supreme Court has said that the matter is sent to the Chief Justice of Pakistan for contempt of court proceedings against the two judges committees.
The Chief Justice of Pakistan should form a full court on this matter, the Practice and Procedure Committee and the Judges Constitutional Committee have ignored the judicial order.
The Supreme Court has terminated the show cause notice proceedings against Additional Registrar Judicial Nazar Abbas.
Earlier, Supreme Court’s Additional Registrar Judicial Nazar Abbas has challenged the contempt of court show-cause notice issued against him.
Additional Registrar Judicial Nazar Abbas has also field for a stay order against ongoing contempt of court proceedings.
