Revised Coal Ash Rules Focus on Recycling and Flexibility

The proposal aims to increase permitting flexibility and encourage the recycling of coal ash into construction materials to reduce waste.

Revisions to regulations governing the disposal and “beneficial use” of coal combustion residuals, commonly known as coal ash, were announced in a move to modernize resource recovery.

The proposal seeks to allow for site-specific considerations in the permitting process, moving away from broader mandates. By encouraging the beneficial use of coal ash, the agency aims to decrease the consumption of new natural resources and improve the strength and durability of resulting cement and concrete.

Under the new framework, permit authorities could tailor requirements for groundwater monitoring, corrective action and closure to specific risks and factors at individual facilities. This shift is intended to provide states with greater oversight and allow for the implementation of new monitoring technologies.

The proposal also establishes uniform standards for storage piles, which may reduce the overall need for traditional disposal methods. Additionally, the rule suggests rescinding certain management unit regulations deemed impractical, citing a goal to reduce burdens on energy production and lower costs for consumers.

Further provisions include additional closure options for facilities that completed the closure of legacy surface impoundments under oversight prior to the effective date of previous rules.

Public comments on the proposal will be accepted for 60 days following its publication in the Federal Register. An online public hearing will also be scheduled to discuss the amendments.
