Missed ITR Filing Deadline? Here’s how to file a belated return

Belated ITR Filing: The due date for filing income tax returns (ITR) for AY 2024-25 lapsed on September 16, with over 7 crore taxpayers completing the process this year. However, many taxpayers and chartered accountants reported glitches and a slow income tax portal during the final days of filing, prompting the government to extend the deadline by one day, from September 15 to 16.

If you still missed the deadline, there’s no need to panic. The Income Tax Act allows you to file a belated return, though it comes with certain conditions and penalties.

What is a Belated Return?

Any ITR filed after the due date is termed a belated return under Section 139(4) of the Income Tax Act. Taxpayers can furnish such a return any time up to three months before the end of the relevant assessment year, or before the completion of assessment, whichever is earlier.

Penalties on Belated Returns

While belated filing ensures you don’t lose the chance to file your return, it may attract late fees under Section 234F:

  • Rs 5,000 if your total income exceeds Rs 5 lakh.
  • Rs 1,000 if your total income is up to Rs 5 lakh.

How to File a Belated Return Online

  1. Visit the official income tax portal and log in.
  2. Go to e-File → Income Tax Returns → File Income Tax Return.
  3. Select the relevant assessment year and choose “online” as the filing mode.
  4. Pick your applicable status (Individual, HUF, etc.).
  5. Choose the appropriate ITR form.
  6. Verify details in the Personal Information section.
  7. Scroll to the filing section and select 139(4).
  8. Report your income, pay dues, and submit the return.
