Court holds waste collection firm, driver responsible in biker’s death, orders Rs42.7m compensation | The Express Tribune


Verdict announced eight years after accident gives accused one month to pay compensation

KARACHI:

The Senior Civil Judge South has ordered the garbage collection truck company and one of their drivers to pay Rs42.7 million in compensation to the family of a man who was crushed by a garbage collection vehicle.

Announcing the verdict, eight years after the accident, the court ordered the defendants to pay the compensation to the plaintiffs within one month.

The court held the truck owners, Nisar Jan and Co and driver Daniel Masih, responsible for the accident. Four other defendants were acquitted in the case. The defendants had not raised any objection to the compensation claim.

It may be recalled that the victim Umar Yaseen Ansari along with his friend Ghiyasuddin was riding a motorcycle in North Karachi when a garbage truck hit their bike from behind in 2017. Umar died on the spot while his friend sustained injuries.

Medical documents and other evidence were presented to the court that confirmed the cause of the accident and death of the biker as cardio-respiratory failure due to the head injury. 

The family of the deceased had filed the claim against six parties, including the truck company, Clifton Cantonment Board, a private bank as a lessor, and the truck driver.

The accused argued that a sessions court had acquitted them in the related criminal case, claiming that no such accident had occurred involving their truck.
